Dear  Mr. President,

I hope this letter finds you well. There are a lot of things that I’d like to talk to you about, and I know that you know that this is all about the new law that you signed way back September of 2012.

Freedom, this is what we have been fighting for over the years. A lot of bloodsheds have been done for our nation in order for us to achieve this state, and sad to say our very own President has deprived us of such.

You have set an effective date on October 3, 2012 for the Cybercrime Prevention Act of 2012  to take over our nation. I have read the complete context of the Act and for me; its scope is very broad and at the same time vague.  What really shocked me the most is the 12 year max imprisonment hence, the term prision mayor,(which you already know, just for the benefit of anyone else reading this) which is the imprisonment of more than 6 years and a day, and a fine of 1M pesos.  I’ve seen and I’ve heard that its worse than rape, lucky rapist!

I am a blogger and a micro blogger. I write what I feel and I can express freely what I feel through the context of blogging. What if I get upset? or get pissed? and what if I start to rant on my facebook status or I start cussing over my twitter account? Or what if I start blogging down on my negative thoughts about people, what if I critic on a subject matter…of course it’s a critic, there should be negative and positive aspects of the subject matter…can the law be more specific on to what extent can they held me liable for such act of libel..?

Mr. President, you do well know that libel, as defined in the revised penal code, “is the public and malicious imputation of a crime, or of a vice or defect, real or imaginary, or any act, omission, condition, status, or circumstance tending to cause the dishonor, discredit, or contempt of a natural or juridical person…”  hence, the words, REAL OR IMAGINARY. Could things get any worse? Well.. I’ll be damned if I’m  gonna be lying and I’ll be too damned if Im telling the truth.

In addition, the Supreme Court of the Philippines (for the benefit of anyone else reading this again) has also ruled that even ironic, suggestive, or metaphorical language could be considered libelous. I don’t have to directly call someone a pervert or a liar, just by being sarcastic about it and being out on the internet, I will be charged with libel. Seriously!?

Saying something bad about dead persons is a crime, Mr. President, what the hell are you thinking? If I am to talk about your best enemy in my blog, former President Ferdinand Marcos and everything of his ill wicked deeds and ill-gotten wealth, which is basically for a fact a part of Philippine history, I should be sentenced for 12 years in prison? You’re kidding right?

Mr. President, please do tell me what dates are covered by the law? Coz surely I don’t have the time in going back over my timeline way back 2009 just to delete those possible libelous comments and statuses that I have made at that time. As I have read from Disini, he discussed that “ if you published something before the law took effect and  if you’re still publishing it after the law took effect, then you’re liable for its publication today.”  For heaven’s sake, please be more specific.

Mr. President, you do know that I love my friends so much, please don’t include them on whatever faults I have. If ever they liked my status of Facebook or retweeted my tweets on twitter, give them a chance, I’ll tell them to never do it again, for In the law you signed, it states that those who play a part in unwittingly or willfully encouraging the spread of libelous content shall be charged for abetting libel. Oh my… :C

Mr. President, if you have read the law you’ve signed, cybersex,  under the Cybercrime Prevention Act, is a crime.. I agree to this if its profit oriented, you and your senators define cybersex as “The willful engagement, maintenance, control, or operation, directly or indirectly, of any lascivious exhibition of sexual organs or sexual activity, with the aid of a computer system, for favor or consideration.” So what if my boyfriend ,who is at the other side of the world, and I decided to get it “on” online? It’s between two consenting adults for heaven’s sake! Shall I be stoned to death if ever that leaks out?

Don’t get me wrong Mr. President , the law itself has good parts, like the punishable acts of child pornography and identity theft but please, the nasty parts could nevertheless be ignored. Quote and quote.. this Act is tagged as a  mala prohibita law, which means you don’t need a criminal mind to be convicted. (this is again for the benefit of anyone else reading). Completely ridiculous eh? I know!

Mr. President, sooner or later you’ll realize how much reviewing you need to do with the law.. we voted for you so that we will be your boss, you should’ve asked the public or your countrymen their thoughts on such law that you have signed. I do hope you’ll make amendments.. nothing but prayers for you Mr. President.
